Some of our readers in Pennsylvania may have an image of divorce cases in their minds: arguments, heated emotions and courtroom battles over the very heart of issues involving your family. However, that doesn’t have to be the way such cases play out. Anyone in Pennsylvania who is contemplating a divorce should probably think to themselves: Is litigation always the answer in a divorce case?

Alternative strategies in divorce

The simple answer to this question is “no,” litigation doesn’t need to be a part of every divorce case in Pennsylvania. In fact, although many divorce cases do lead to hurt feelings and raw emotions from the parties involved, some divorces result simply because the couple have “drifted apart,” and want to go their separate ways. There may not be all that much emotional turmoil in such cases. And, as a result, divorcing couples in such cases may be able to agree, for the most part, on many of the issues that need to be addressed in the legal case. This may be particularly true for couples who do not have minor children.

For divorcing couples who find themselves in this situation, an “uncontested” divorce may be possible. In this type of arrangement, the couple doesn’t have issues to argue about, they know how they would like to divide assets and debts and, in general, they simply need to go through the legal process of dissolving their marriage. This approach, if possible, can save all parties time and money.
